What's an Implied Contract?
An implied contract is more like when you and your friend start playing a game, and both know the rules even though you never said them out loud. For example, every time you go to the store with your mom, she gives you money to buy snacks, you both understand that if you get the snacks, you’ll bring them home. No one writes it down, but it still works!
Sometimes, people use express contracts when they want things to be super clear, and implied contracts are used in everyday life without anyone thinking about it! A contract is just a promise between people, sometimes written, sometimes not, that helps them know what to expect from each other.
Examples
- A restaurant waiter says, 'Would you like dessert?' You say, 'Yes.' This is an implied contract, you agree to pay for it later.
- You sign a lease agreement with your landlord. That's an express contract because the terms are written out clearly.
